Nationwide Planning Associates is based in Paramus, New Jersey and has approximately twenty-five registered branch offices and about sixty-nine registered representatives.
The FINRA Disciplinary Action
However, according to a recent disciplinary action, Nationwide settled with the Financial Industry Regulatory Authority, it was found or otherwise agreed that at least between March 2010 and May 2012, Nationwide representatives used certain advertisements and sales literature which contained unbalanced, exaggerated and misleading statements, including in one case, where one registered representative sent out approximately 323 documents to customers containing projected annualized returns using certain stock transactions that had realized positive performance but that omitted stock transactions included losses.
It was also found that during the Relevant Period, Nationwide failed to retain all business-related emails sent to or from registered representatives, and was aware that several registered representatives used personal email accounts to send and receive business-related emails. However, the Firm failed to take steps to retain those business-related emails or establish, maintain, and enforce an adequate supervisory system for the review of its registered representative’s e-mails.
