Joseph Francis Bartosiewicz Jr. of Stamford, Connecticut, a stockbroker registered with LPL Financial LLC, has been barred from associating with any Financial Industry Regulatory Authority (FINRA) member in any capacity because Bartosiewicz failed to provide information and documents to FINRA during the time that it investigated possible violations of FINRA rules during the time that he was associated with LPL Financial LLC and Sagepoint Financial Inc. FINRA’s sanctions stem from an investigation into Bartosiewicz’s conduct after FINRA censured Sagepoint Financial Inc. and fined the securities broker dealer $700,000.00 for failure to supervise. Letter of Acceptance, Waiver, and Consent No. 2019062873301. In that regulatory action, FINRA found that Sagepoint failed to create and manage a supervision system for purposes of supervising the stockbrokers who had a history of misconduct in the securities industry. FINRA found that the securities broker dealer did not make clear who was responsible for instituting heightened supervision requirements and disciplinary measures. FINRA also found that Sagepoint had a fragmented and unreasonable method of maintaining records on stockbroker disciplinary histories. Those supervisory failures caused the securities broker dealer not to take steps to address the misconduct. Sagepoint violated FINRA Rules 2010 and 3110.
On June 22, 2023, as part of the regulator’s investigation into Bartosiewicz, FINRA requested Bartosiewicz to submit certain documents and information. However, Bartosiewicz, through his lawyer’s email to FINRA on July 6, 2023, confirmed he had received the request but also stated he won’t be providing the requested documents and information. His refusal to comply with the FINRA’s request resulted in him violating FINRA Rules 8210 and 2010.
Bartosiewicz Jr was registered with LPL Financial LLC as a stockbroker and investment adviser representative between January 18, 2022, and April 28, 2023.
