Gianluca De Berardinis, also known as Gianluca Deberardinis, of New York, New York, a stockbroker previously registered with Morgan Stanley, was the subject of a customer initiated investment related complaint filed on August 18, 2023. In this complaint, the customer requested $200,000.00 in damages based upon allegations that De Berardinis engaged in selling away or solicited a private placement investment unaffiliated with Morgan Stanley in 2020. The complaint was later withdrawn.
In any event, two months earlier. on June 23, 2023, Morgan Stanley permitted De Berardinis to resign based upon allegations that De Berardinis was involved with offers or sales of equity private placements not approved by the firm.
On August 17, 2023, a customer initiated investment related complaint involving De Berardinis’s conduct was settled for $23,820.70 in damages. This settlement was based upon an alleged unauthorized withdrawal of funds from the customer’s account in connection with the sale of non-Morgan Stanley investments between 2022 and 2023.
De Berardinis states that the termination or resignation was so that De Berardinis could start a registered investment advisory firm,
De Berardinis was associated with Morgan Stanley in New York, New York from February 4, 2014, to June 23, 2023.
This is not the first time that De Berardinis has been referenced in a customer initiated investment related dispute concerning De Berardinis’s conduct in the securities industry. Financial Industry Regulatory Authority (FINRA) Public Disclosure shows that Berardinis was also referenced in a customer initiated investment related complaint filed on December 6, 2022. In this instance, the customer alleged that De Berardinis misrepresented the risk to his principal in the purchase of a structured product in 2022. This complaint was also withdrawn.
